New Delhi [India]October 5 (ANI): The Delhi Metro Rail Corporation (DMRC) has once again failed to comply with the Delhi High Court’s order directing it to pay an arbitration award of Rs 4,500 crore to Reliance Infrastructure subsidiary Delhi Airport Metro Express Private Limited (DAMEPL) within the deadline of four weeks.
In the last six months, this is the third High Court order for contempt by the DMRC.
The Delhi High Court, in its latest order dated September 6, 2022, directed DMRC to pay the entire arbitration award amount of Rs 4,500 crore to DAMEPL within four weeks, i.e. by October 4, but failed to comply with the court’s order as he has not made any payment to DAMEPL as the deadline expired yesterday.
DAMEPL’s legal team said that it has been almost 13 months that DAMEPL, despite a Supreme Court decree in its favour, followed by 3 Delhi High Court orders on its writ of execution, directing DMRC to make the payment, he was struggling to get his dues from DMRC.
Earlier in March 2022, the Delhi High Court, after hearing DAMEPL’s enforcement plea, passed an order on March 10, 2022, directing DMRC to pay the entire amount in two equal installments by April 30 and May 31, 2022. DMRC failed to comply with this order.
DAMEPL again approached the Delhi HC to enforce the March 10 order. The court then passed an order on June 20 directing DMRC to make the full payment by August 5, 2022. DMRC also failed to comply with this order.
In the latest order dated September 6, the court also directed that if the amount is not paid within four weeks, the court will be forced to summon the DMRC managing director before the court.
The next hearing is scheduled for October 10, 2022.
Earlier, DAMEPL had filed an execution petition in the Delhi HC on September 12, 2021, seeking the court’s direction that DMRC comply with the SC order and pay Rs 7,200 crore to the company. DMRC, out of Rs 7,200 crore, has paid only Rs 1,000 crore so far.
On September 7, 2021, the Supreme Court confirmed the arbitration award of 7,200 kroner in favor of DAMEPL.
In 2008, DAMEPL entered into an agreement with DMRC to run the Airport Metro line till 2038. As disputes arose between the parties, DAMEPL stopped operating the metro on the airport line and invoked the arbitration clause against DMRC for alleged breach of contract and sought termination benefits.
